Why haven’t I heard anything about my deposit?

If you request your deposit back at the end of your tenancy and you don’t hear anything within 14 calendar days of your tenancy coming to an end, you are eligible to make a claim to get your deposit back.

In order to do this, you must ensure that you have logged onto the relevant deposit scheme with the logins provided at the commencement of your tenancy and formally requested the return of your deposit. When the relevant scheme contacts you to advise, you can complete a Statutory Declaration form and this must clearly state the reasons for your claim, along with the amount that you are claiming. For your claim to be accepted, it must be witnessed by a solicitor. 

When your completed claim reaches the Deposit Protection Scheme (this is the scheme Imagine uses), your landlord or agent will be notified. 14 days from this point, if you have not received any response, the funds that have been requested will be paid back in full as per your claim. 

Any disputes against the claim must be made within 14 days of the landlord and agent being notified of the claim. If a dispute is made against the full deposit you will be notified for the reasoning behind it and will then have an additional 14 days to accept or disagree. You will also have the opportunity to submit evidence to support your case.

If the claim has still not been resolved after these time periods, this is when the Dispute Resolution Service step in and assess all of the evidence and reasonings provided from both your landlord/agent and you. The DRS will then make an informed decision of the funds that will be paid back to both parties.
